According to the Consumer Financial Protection Bureau (CFPB) database, the CFPB received 900 complaints from consumers regarding Comenity Bank from November 3, 2017 to November 3, 2020.  148 of these complaints about Comenity Bank related to fees or interest, 101 of the complaints related to incorrect information appearing on the consumer’s credit report, 90 complaints related to a problem with a purchase shown on the consumer’s statement, 59 complaints related to Comenity Bank’s communication tactics, 57 complaints related to account closure, 47 complaints related to Comenity Bank’s attempts to collect debt not owed, 20 complaints related to false statements or representations by Comenity Bank, and 20 complaints related to improper threats by Comenity Bank to contact a third party or share information improperly.

If you are receiving automated collection calls on your cell phone from Comenity Bank, you have rights under the Telephone Consumer Protection Act, and could be entitled to $ 500 – $1,500 per violating call.

If you are receiving collection calls from Comenity Bank and you are a California resident, you may be entitled to up to $ 1,000 under the Rosenthal Fair Debt Collection Practices Act.

If Comenity Bank is reporting incorrect information to credit bureaus about you, you may be entitled to $ 1,000 per willful violation of the Fair Credit Reporting Act.  If Comenity Bank is reporting incorrect information which appears on your credit and you are a California resident, you may be entitled to up to $ 5,000 per willful violation of the California Consumer Credit Reporting Agencies Act.
